Posted by Anne Bishop, Lynam, September 20, 2005:I would like to know how many towns have a Personnel Policy that states the selectmen have the final say as to who the Treasurer, Tax Collector or Town Clerk may appoint as their Deputy. I know the selectmen can appoint a deputy if one of these officials are out and have not appointed one, I am talking about at all times.
Responses: In Guilford, the selectmen appoint the clerk, the treasurer, the tax collector, (and the town manager,) and during the same board meeting, which follows the annual March town meeting, they also appoint all the deputies. While I'm sure they would listen to an opinion from a primary office, the decision is theirs.(Tom Goullette, Guilford)
I wasn't aware that anyone except the actual treasurer, clerk or tax collector had any say about the PERMANENT appointment of his or her deputy; I think that only in their absence would the council or selectmen have that authority. It was always my understanding that is the tax collector, treasurer and clerk was elected then the elected official could choose their deputy. If appointed then the selectmen had the final say. Check with MMA (Sylvia Gray, Newry)

I did contact MMA and they said that according to State Law it is the treasurer, tax collector or town clerk who appoints their deputy. I was just checking to see if it was done different in other towns where Lyman wants to have the selectmen have the final say. (Anne Bishop)
